Agreement

By creating an account or using ThriveChamp, you agree to these Terms of Use and acknowledge the Privacy Policy and Wellness Disclaimer. If you do not agree, do not use the service.

What ThriveChamp Provides

ThriveChamp is a web app for daily puzzles, score tracking, general wellness activities, meal ideas, workout options, reading, and interests-based content. The service is intended for personal, informational, educational, and entertainment use.

No Professional Advice

ThriveChamp does not provide medical, nutrition, dietetic, physical therapy, personal training, mental health, financial, legal, or other professional advice. Meal ideas, macro estimates, workout options, and score systems are general tools only. You are responsible for deciding whether an activity, recipe, food, or workout is appropriate for you.

Your Account

You are responsible for keeping your login information secure and for activity under your account. Provide accurate information where the service asks for profile details, preferences, or safety-related exclusions.

Age Requirement

ThriveChamp is not directed to children under 13. By using the service, you confirm that you are at least 13 years old. If you are under the age of majority where you live, use the service only with permission from a parent or guardian.

Acceptable Use

Do not misuse the service, attempt to access accounts or systems without permission, interfere with app operation, submit harmful code, or use ThriveChamp in a way that violates law or infringes the rights of others.

Third-Party Content, Links, and Ads

ThriveChamp may show advertisements, affiliate or third-party links, articles, recipes, videos, media, or external content. Third-party content belongs to its respective owners. We are not responsible for third-party sites, products, services, claims, or availability.

Availability and Changes

We may change, suspend, or discontinue parts of ThriveChamp at any time. Scores, content, features, archives, and rewards may change as the product evolves.

No Guarantees

ThriveChamp is provided as is and as available. We do not guarantee specific health, fitness, weight, nutrition, learning, financial, or lifestyle outcomes.

Limitation of Liability

To the fullest extent permitted by law, ThriveChamp and its operators will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, or for decisions you make based on app content.

Dispute Resolution, Arbitration, and Governing Law

Governing Law

These Terms, your use of the ThriveChamp website, and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, the Wellness Disclaimer, or your use of the ThriveChamp website and services shall be resolved entirely through binding, individual arbitration, rather than in court. You and ThriveChamp agree that the U.S. Federal Arbitration Act governs the interpretation and enforcement of this provision. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Miami-Dade County, Florida, or via telephone or video conference.

Class Action and Jury Trial Waiver

YOU AND THRIVECHAMP AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, WE EACH MUTUALLY WAIVE ANY RIGHT TO A JURY TRIAL.
